Over the next months we will be reporting on arrests in Broward County, Fort Lauderdale with some criminal defense lawyer commentary. We were not retained by any of these people but, in reviewing these we feel we can shed some light on the Fort Lauderdale arrest process. For Instance: The winner of Bellator's Season Six Featherweight tournament, was arrested on March 1, and is being held on $2,200 bail. He was arrested in Fort Lauderdale and charged with driving with a suspended license, possession of cannabis over 20 grams, possession of drug paraphernalia or use and possession of MDMA (ecstasy). Many athletes have been arrested not only for drugs but, for the illegal use of steroids. Athletes are not above the law and an arrest, although it is publicity, can be extremely harmful to reputation and career. If you have a Florida suspended license and are an unlicensed driver in an accident you will most likely be arrested for driving with a suspended license but, you will not automatically be considered at fault. It is a mis belief that if you are in an auto auto accident and do not have a valid driver’s license that you are responsible for the accident. Let's face it you are considered to be a criminal. As an unlicensed driver, you need to understand this potential bias. You may be stuck in court facing two situations. In order for you to be found liable for the accident, it must be shown that you were negligent in the operation of the car or vehicle. It must also be found that that your negligent behavior was the “proximate cause” of the accident. Can it be argued that driving a motor vehicle without a license is in itself negligent? And if it is negligent, was the accident the “natural and probable consequence” of driving without a license? In Broward county we are dealing with some very tough and biased judges.
